K3 Visa Process in a nutshell

 

1. The US Citizen files the Petition for Alien Relative, form I-130 for the foreign spouse. Once the USCIS Notice of Action (Form I-797) is received, the US Citizen spouse files form I-129F and petitions for a K-3 visa for their foreign spouse.

 

2. After the I-129F has been approved, the spouse has 4 months from the time the I-129F was approved to obtain the K-3 Visa at the US Consulate in the foreign country. The K-3 visa must be applied for in the country where the marriage took place unless the marriage took place in the U.S.

 

The following is required to apply for the visa:

  • Two copies of form DS-156, Nonimmigrant Visa Application
  • One DS-156K, Nonimmigrant Fiancée/Spouse Visa Application form
  • Police certificates from all places lived in since the age of 16
  • Birth certificates
  • Marriage certificate for spouse (good idea to bring additional proof of marriage)
  • Death and divorce certificates from any previous spouses
  • Medical examination (except vaccinations)
  • A passport valid for travel to the United States and with a validity date at least six months beyond the applicant's intended period of stay in the United States.
  • Two non immigrant visa photos- two inches/50 X 50 mm square, showing full face, against a light background
  • Proof of financial support (Form I-134 Affidavit of Support may be requested.)    

3. The K-3/4 nonimmigrant classification does not provide immigrant status. To obtain immigrant status, a K-3 nonimmigrant must file a Form I-485 (Application for Adjustment to Permanent Residence) once in the United States. You will also apply for an Employment Authorization Document (EAD).

 

4. You may wait a year or more to be interviewed for Permanent Resident status (green card).

  

5. Further on down the road, you can apply to become a United States citizen.
